Adivasi and forest-dweller organisations have asked the Ministry of Tribal Affairs to withdraw an office memorandum stating it has no role in requiring Gram Sabha consent before forest land is diverted for non-forest use.

◈ Background & Context

On 31 August, the Ministry of Tribal Affairs (MoTA) issued an office memorandum stating there is "no provision" under the Forest Rights Act (FRA), 2006 for obtaining Gram Sabha consent at the Stage-II forest clearance stage, and that such matters fall outside its purview.

  • The memorandum followed a Parliamentary Committee on Public Undertakings report noting NHPC's concern that Gram Sabha consent requirements were delaying its projects.
  • The Campaign for Survival and Dignity (CSD), a national platform of Adivasi and forest-dweller groups, has called the Ministry's position factually and legally untenable.

The statutory position

  • MoTA was assigned responsibility for "all matters including legislation relating to the rights of forest dwelling Scheduled Tribes on forest lands" through a March 2005 amendment to the Government of India (Allocation of Business) Rules, 1961.
  • Section 11 of the FRA, 2006 designates MoTA as the nodal authority for implementing the Act, including rules and guidelines on Gram Sabha consent before forest clearance under the Forest (Conservation) Act, 1980.
  • The Supreme Court's Niyamgiri judgment [(2013) 6 SCC 476] affirmed free, prior and informed consent of Gram Sabhas as a prerequisite for forest clearance.

CSD argues the sequence — rights recognition, Gram Sabha consent, then clearance — is settled law that the August memorandum contradicts.

The critical view

CSD cites government data that roughly 3,05,945 hectares of forest land were approved for non-forest use between 2008-09 and 2022-23 without full FRA compliance, disputing the claim that consent requirements are the main cause of project delays.
